Fox News has won its second defamation ruling in as many days after a federal judge in Delaware on Wednesday dismissed a former Trump supporter’s claim that ex-host Tucker Carlson acted with “actual malice” when he said he was a government provocateur during the Jan. 6 insurrection.

Ray Epps had argued that he was falsely accused of being a federal informant who played a role in fomenting the riot.

A federal judge has tossed a defamation lawsuit against Fox News over a Tucker Carlson special about the Jan. 6 attack, where he spread false conspiracy theories, CNN reported. Conservative conspiracy theorists spread falsehoods including that a supporter of Donald Trump was a federal agent who incited the attack.

Fox News has won the dismissal of a lawsuit brought against the network and former host Tucker Carlson by a Trump supporter who claims he lost his job after the channel aired conspiracy theories related to the January 6 insurrection.
